TERMS AND CONDITIONS OF THE TIDYFY PLATFORM

Welcome to the Terms and Conditions of the Tidyfy Platform!
We appreciate that you have taken the time to learn more about how we protect your rights.
If you are reading this document, it shows that you value transparency and quality in the services you use.
We want to assure you: at Tidyfy, we care not only about high-quality cleaning services and friendly customer support but also about full compliance with Users’ rights.
All our documents have been prepared in accordance with applicable laws to ensure you are fully informed and your rights are protected.
If you have any questions, please contact us — every inquiry is important to us and deserves an answer.

§ 1 Definitions

  1. Platform Owner 
  2. Civil Code – the Act of 23 April 1964, Civil Code (Journal of Laws 2022, item 1360).
  3. Account – the User’s virtual account on the Platform, through which the User enters and manages data and receives information or messages from Tidyfy.
  4. Client – a User who has ordered and paid for Services.
  5. Newsletter – electronic messages sent to the User via email or SMS, including information bulletins, commercial and marketing messages (including discounts and promotions), and updates about the Platform’s features.
  6. Payment Operator – PayPro SA, based in Poznań, ul. Pastelowa 8 (60-198), KRS: 0000347935, NIP: 7792369887, fully paid share capital of PLN 5,476,300.00, registered with the Financial Supervision Authority under number UKNF IP24/2014.
  7. Platform – the website www.tidyfy.pl, which allows Users to order cleaning services under these Terms and Conditions.
  8. Regulations / Terms and Conditions – this document.
  9. GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.
  10. Account Agreement – a distance contract between Tidyfy.pl and the User for the provision of electronic services consisting of maintaining a User Account.
  11. Service Agreement – a distance contract between Tidyfy.pl and the User for cleaning or other services available on the Platform.
  12. Services – cleaning and additional services provided by Tidyfy or its Contractors.
  13. Personal Data Protection Act – the Act of 10 May 2018 on the protection of personal data (Journal of Laws 2019, item 1781).
  14. Copyright Act – the Act of 4 February 1994 on copyright and related rights (Journal of Laws 2022, item 2509).
  15. Consumer Rights Act – the Act of 30 May 2014 on consumer rights (Journal of Laws 2020, item 287).
  16. Electronic Services Act – the Act of 18 July 2002 on the provision of electronic services (Journal of Laws 2020, item 344).
  17. User – a natural person, legal entity, or organizational unit without legal personality granted legal capacity by law, who uses the Platform. A User may also be a Client.
  18. Contractor – an employee or collaborating person (including under a civil law agreement) fully qualified to perform Services on behalf of Tidyfy.
  19. Order – a set of actions performed by the User or Client expressing the intent to conclude a Service Agreement and including the data provided in the order form.
  20. Words in the plural also refer to the singular and vice versa.

§ 2 General Provisions

  1. These Terms and Conditions define the rules of operation and use of the Platform and specify the rights and obligations of Users (including Clients) and Tidyfy.
  2. Using the Platform means the User accepts these Terms and Conditions.
  3. For Users who are legal persons or organizational units, a representative must be indicated.
  4. Users may access these Terms and Conditions at any time via a link on the Platform or by email upon request. They may download, print, or save them on a durable medium.
  5. User obligations, including payment obligations, remain effective until fulfilled or until the limitation period expires.
  6. These Terms do not exclude or limit any statutory rights of Consumers under applicable law.

§ 3 Account and Platform

  1. Registration and login are done through the registration form available on the Platform.
  2. The Account Agreement is concluded upon successful registration at www.tidyfy.pl
  3. To conclude the Account Agreement, all mandatory fields on the registration form must be filled out, and the email address verified.
  4. After registration, the User logs in using their email address and password.
  5. Registration is voluntary and free of charge.
  6. Logged-in Users can access their dashboard displaying personal data, Orders, and related information.
  7. Each User may have only one Account.
  8. Tidyfy provides Users with access to their personal data and allows for its correction and update.
  9. Withdrawing consent to any part of these Terms requires the User to delete their Account or notify Tidyfy.
  10. Tidyfy may suspend or block Accounts in case of breaches of these Terms or applicable laws, or if actions harm other Users or Tidyfy.
  11. Platform functionalities may be modified, added, removed, or temporarily disabled at Tidyfy’s discretion.
  12. Users must not share their login credentials with third parties.
  13. The User declares that the data provided during registration is complete, accurate, and truthful.
  14. The Account Agreement is concluded for an indefinite period.

§ 4 Services

  1. The main types of Services available on the Platform are:
    a. post-move-out cleaning,
    b. one-time cleaning,
    c. post-renovation cleaning.
  2. Prices depend on apartment size and room type.
  3. The time shown in the order form is an estimate and may vary during service execution.
  4. Users may also select additional Services displayed in the order form with their descriptions and prices.

§ 5 Rules for Performing Services

  1. Services are provided only in residential premises within the city of Poznań.
  2. Services do not include basements or attics.
  3. Cleaning applies only to external surfaces of movable items; their placement is not altered.
  4. Detergents, vacuum cleaners, and mops are not included in the price — the User must provide them. If unavailable, Tidyfy may provide these for an additional fee.
  5. A paid Service is linked to the personal data or Account used to place the Order.
  6. The User must make the premises available at the agreed service time.
  7. Changes or cancellations are handled under § 9.
  8. Complaints are handled under § 8.

§ 6 Orders

  1. Users may place Orders 24/7 via the Platform.
  2. Registration is not mandatory, but acceptance of the Terms and required consents is.
  3. Orders are placed in several steps: service selection, property details, time selection, user data, payment method, acceptance of consents, and confirmation.
  4. The Service Agreement is concluded when the Order is submitted.
  5. Orders are processed upon payment or after service if payment on delivery is chosen.
  6. Users must provide complete and accurate data.
  7. Order confirmation is sent via email or displayed in the User’s Account.
  8. Execution time may be extended due to unforeseen circumstances, and the User will be notified.
  9. Tidyfy confirms the Order and its details via email or in the Account.
  10. Orders cannot be placed in any other way than through the Platform.

§ 7 Prices and Payments

  1. Service prices are shown on the Platform or in emails sent upon request.
  2. All prices are in PLN and include VAT.
  3. Payment methods include:
    a. via the Payment Operator (Przelewy24),
    b. by bank transfer,
    c. in cash at the service location.
  4. When using the Payment Operator, Users are redirected to a secure Przelewy24 payment page. Users must follow the Operator’s terms and regulations.
  5. No other payment methods are available.
  6. Settlements are based on the order form terms.
  7. Users consent to receive electronic invoices and corrections via email. The document is considered delivered upon sending.
  8. Tidyfy may grant discounts or promotions at its discretion.

§ 8 Complaints

  1. Consumers or entrepreneurs with consumer rights may file complaints within 24 hours of service completion via email (info@tidyfy.pl) or contact form.
  2. Complaints are processed within 14 days.
  3. Payment-related complaints must be directed to the payment provider.
  4. Consumers may use court or out-of-court dispute resolution mechanisms (e.g., ODR platform).
  5. Tidyfy’s liability under warranty is excluded for non-consumer Users.

§ 9 Service Location, Time, and Cancellation

  1. Clients may request to change the location or time of a Service with Tidyfy’s consent.
  2. Cancellations:
    a. More than 24h before service – full refund,
    b. 3–24h before service – 50% refund,
    c. Less than 3h before service – no refund.
  3. Tidyfy may also reschedule or cancel a Service for justified reasons:
    a. Up to 12h before – reschedule within 24h,
    b. Less than 12h before – full refund.
  4. Refunds are made to the same bank account used for payment.

§ 10 Termination of Agreement

  1. The User may terminate the Account Agreement with 1-month notice or withdraw within 14 days without reason or cost.
  2. Deleting an Account does not release the User from unpaid obligations.
  3. Account deletion results in loss of access to stored data.
  4. Consumers may withdraw from the Service Agreement within 14 days unless they consent to early performance, in which case a proportional refund applies.
  5. Tidyfy may terminate agreements immediately for breaches of these Terms or law, or if a User’s actions are harmful or offensive.

§ 11 Liability

  1. Users must document existing damage before service. Tidyfy is not liable for unreported or undocumented damages.
  2. If access to the premises is denied at the service time, Tidyfy may charge the full service price.
  3. Tidyfy is not liable for Platform interruptions beyond its control.
  4. Tidyfy is not liable for Users’ breaches of third-party rights.
  5. Tidyfy is not liable for damages caused by force majeure or legal changes.
  6. Tidyfy is not liable for payment provider issues.
  7. Tidyfy is not liable for third-party actions.
  8. Tidyfy reserves the right to seek damages under general civil law.

§ 12 Newsletter

  1. Users may subscribe to the Newsletter by consent and email confirmation.
  2. The Newsletter is free and indefinite until unsubscribed.
  3. It contains information about Tidyfy and its Contractors.
  4. Each message identifies Tidyfy as the sender.
  5. Users may unsubscribe anytime via email or through their Account.
  6. Comments about the Newsletter may be sent via email and will be addressed promptly.
  7. Data provided for the Newsletter is processed in accordance with GDPR (legitimate interest – direct marketing).

§ 13 Personal Data Protection

  1. Tidyfy collects and processes personal data to provide services and protect legitimate interests.
  2. Data is processed in accordance with applicable laws and the Privacy Policy available on the Platform.
  3. Tidyfy is the Data Controller under GDPR.
  4. Details of data processing are described in the Privacy Policy at www.tidyfy.pl

§ 14 Technical Requirements

Users must meet the following minimum technical requirements:
a. an internet-enabled device with a display,
b. internet connection,
c. a web browser supporting HTML and W3C standards,
d. JavaScript enabled,
e. cookies enabled.

§ 15 Platform and User Security

  1. Users must follow general internet safety principles.
  2. Without Tidyfy’s consent, Users must not:
    a. analyze, decompile, or modify source code or security,
    b. overload the server,
    c. use software to track or steal data,
    d. attempt to damage, block, or interfere with the Platform.

§ 16 Final Provisions

  1. These Terms take effect on June 1, 2025.
  2. Tidyfy may amend the Terms, Services, prices, or Privacy Policy. Users will be notified via the Platform or email.
  3. Changes are announced at least 3 days before they take effect.
  4. In urgent cases (e.g., legal changes), this period may be shortened.
  5. Updated Terms come into force on the date specified in the notice.
  6. Users may terminate agreements if they do not accept material changes.
  7. Changes do not affect rights acquired under previous versions.
  8. Continuing use of the Platform after changes implies acceptance.
  9. Tidyfy may assign its rights and obligations without User consent.
  10. Users may post content (e.g., reviews); Tidyfy may moderate or remove unlawful or offensive content.
  11. Tidyfy may temporarily disable or permanently close the Platform for maintenance or updates, notifying Users in advance when possible.
  12. In case of a dispute, the Parties shall seek an amicable settlement. Failing that, disputes are resolved by Polish common courts according to general jurisdiction or the consumer’s domicile.
  13. In matters not regulated herein, Polish law shall apply.
